Employers that don’t classify their workers correctly are responsible for not only back employment taxes, but also penalties, and the IRS is cracking down on this, especially in the construction industry.

Intuit QuickBooks makes a list of three things employers can use to decide whether a worker is better classified as an employee or an independent contractor. These factors are behavioral control, financial control, and relationship.
